“Content” means all text, photographs, graphics, logos, menus, prices, hours, event information, links, forms, and other materials made available through the Site. The Site is intended for visitors seeking general information about Panoche Inn. It is not a reservation system, an online store, an alcohol-delivery service, an aviation service, or a substitute for direct confirmation with Panoche Inn.

The Site is provided for lawful, personal, non-commercial use. You agree not to: (a) use the Site for an unlawful or fraudulent purpose; (b) interfere with or disrupt the Site or its security; (c) attempt to gain unauthorized access to any account, system, or data; (d) copy, scrape, frame, republish, or commercially exploit Site Content without written permission; or (e) impersonate Panoche Inn or misrepresent your relationship with us.

We do not intentionally sell personal information or use the Site for behavioral advertising. The Site may use browser storage to remember preferences such as language and accessibility settings. Our hosting provider and service providers may automatically process technical information, such as an IP address, browser type, device information, requested pages, and timestamps, in connection with hosting, security, and delivery of the Site.

Nothing on the Site is professional legal, medical, nutritional, financial, travel, weather, engineering, or aviation advice. Maps, directions, weather information, and other third-party data may be delayed, incomplete, or incorrect.

5. Alcohol Service and Age Verification

Panoche Inn intends to comply with applicable California Alcoholic Beverage Control requirements. Alcoholic beverages are sold or served only to customers who are 21 years of age or older. Valid government-issued photo identification is required and will be checked. We may refuse service or request additional verification at any time.

Age Restriction and Non-Alcoholic Beverage Policy
NOTICE: Although California law may permit persons under 21 years of age to purchase certain non-alcoholic beverages, Panoche Inn has adopted a stricter house policy as a safety precaution. Panoche Inn will not sell non-alcoholic beverages to anyone under 21 years of age. Alcoholic beverages are sold only to customers 21 years of age or older, and valid government-issued photo identification is required and checked.

FAKE ID WARNING: Our staff has more than 30 years of experience verifying identification and knows what to look for. Do not attempt to use a fake, altered, borrowed, or otherwise invalid ID. We may refuse service and report suspected identification fraud to law enforcement.

These age and service policies are house policies and do not expand or limit any rights or obligations imposed by applicable law. No person is entitled to service solely because the Site describes a product, service, event, or operating hour.

6. Premises, Events, and Airstrip Safety

Visiting Panoche Inn or participating in activities, events, outdoor areas, or recreational amenities may involve ordinary and inherent risks, including uneven ground, weather, vehicles, smoke, alcohol-related conduct, food allergens, animals, and other persons’ actions. You are responsible for using reasonable care, following posted instructions, and supervising minors and personal property. Do not drive while impaired. Call 911 in an emergency.

The adjacent airstrip is subject to its own conditions, rules, permissions, and hazards. Anyone considering its use must obtain current information, comply with all applicable aviation requirements, and complete and submit the required waiver before using the airstrip. The Site does not guarantee that the airstrip is open, safe, inspected, or available for any particular aircraft or operation.

7. Limitation of Liability

To the fullest extent permitted by law, Panoche Inn and its owners, operators, employees, agents, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business, arising out of or relating to the Site, Site Content, third-party services, or reliance on information published through the Site.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, willful misconduct, or rights that cannot be waived under applicable law. Any claim relating to the Site must be brought within the time permitted by applicable law.

8. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Panoche Inn and its owners, operators, employees, agents, and service providers from claims, losses, liabilities, damages, costs, and reasonable attorneys’ fees arising from your unlawful use of the Site, violation of these Terms, misuse of Site Content, or violation of another person’s rights. This provision does not require indemnification for losses caused by conduct that cannot legally be allocated to you.

9. U.S. Surgeon General's Warning
GOVERNMENT WARNING: (1) According to the Surgeon General, women should not drink alcoholic beverages during pregnancy because of the risk of birth defects. (2) Consumption of alcoholic beverages impairs your ability to drive a car or operate machinery, and may cause health problems.
SURGEON GENERAL'S ADVISORY (2025): Alcohol increases risk of breast cancer, colon cancer, liver cancer, and cancers of the mouth, throat, voice box, and esophagus. For your health, drinking less is better than drinking more. For more information, visit CDC.gov/alcohol.
10. California Proposition 65 Warning
WARNING: Alcoholic beverages are sold and consumed on these premises. Drinking alcoholic beverages during pregnancy can cause birth defects. Alcoholic beverages contain chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm.
11. Governing Law and General Provisions

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except to the extent superseded by applicable federal law or non-waivable consumer protections. Subject to applicable law, disputes relating to the Site shall be brought in a court with appropriate jurisdiction in California. If any provision is held unenforceable, it will be modified or severed only to the minimum extent necessary, and the remaining provisions will remain in effect. A failure to enforce any provision is not a waiver of future enforcement. These Terms, together with the policies and disclosures on this page, constitute the entire agreement concerning use of the Site.
